Real Estate Advertising Regulations:

 

First: The real estate service provider must submit real estate advertisements in accordance with the real estate advertising regulations issued by the General Authority for Real Estate on 12/10/1442 AH.

Second: Without prejudice to the competencies of the relevant authorities and the General Authority for Audio-Visual Media, the following must be adhered to in real estate advertisements:

  1. Ensuring honesty and integrity.
  2. Avoiding anything that may cause confusion or mislead the public.
  3. Complying with the general guidelines for advertising content.
  4. Adhering to the ethical and informational content regulations issued by the relevant authorities in all media formats (traditional and electronic).
  5. Using the official names of cities, neighborhoods, streets, and types of real estate, with the option to add commonly known names.
  6. Including the following data:

       Indication that it is an advertisement.

       Specifying the purpose (sale, rent, investment, etc.).

       Specifying the type of real estate.

       The advertiser's name and capacity (owner, authorized agent).

       The advertiser's license number if it is an office or real estate marketer or holder of a freelance document.

       The location of the real estate, containing at least (city - neighborhood - plot number if available).

       An effective means of communication with the advertiser.

       Disclosure of real estate data as follows:

       The area of the real estate.

       Any ongoing disputes concerning it – if any.

       Any mortgage or restriction that prevents or limits the disposal or use of the real estate.

       Rights and obligations on the real estate not documented in the real estate document.

       Services related to the real estate.

       Information that may affect the real estate, whether lowering its value or influencing the target's decision in the advertisement, such as guarantees and their durations, compliance with the Saudi building code, the age of the existing property, etc.

       If the advertisement is for a real estate auction, it must – in addition to what is issued by the relevant authorities – include the auction license number, its location, conditions, scheduled date, duration, and final date – if any – for auction submission.

Third: Real estate advertisements on the electronic real estate platform must – in addition to the data mentioned in the Second item – contain the following data:

  1. Description of the real estate, including its type, age, contents, and any influencing description, such as street width, real estate facade, etc.
  2. Boundaries and dimensions of the real estate.
  3. The price of the real estate.

Fourth: Without prejudice to the competencies of the relevant authorities, it is prohibited to include any of the following in real estate advertisements:

  1. Violation of Islamic instructions, regulations, or customs prevailing in the Kingdom.
  2. Indecency.
  3. Violation of intellectual property rights.
  4. Negative exposure to competitors or private sector establishments or others.
  5. Phrases or indications that imply discrimination against anyone.
  6. Misleading images, data, locations, or perspectives that do not belong to the advertised real estate.
  7. The logo or name of the Authority or any other governmental entities, except with prior permission.

Fifth: It is prohibited to publish fake real estate advertisements for the purpose of collecting recipient data or the public or for any other purpose.

Sixth: The real estate advertisement must be removed within a period not exceeding two days from the date of completion or termination of its purpose.

Seventh: The Authority will monitor compliance with these regulations and refer any violations to the competent authorities for legal action.

Eighth: Exemptions from the application of these regulations include:

  1. Real estate advertisements from governmental entities.
  2. Off-plan sale or lease advertisements.
